County, 4,360 acres; surface Federal <br />coal mine. Consideration of a request to vacate NOV C-93-026 <br />issued for failure to design, control and maintain sediment <br />control structures to provide protection for topsoil and <br />vegetation and failure to retain sediment within the disturbed <br />area (continued from the August 1993 Board Meeting). <br />Staff distributed EXHIBIT A, a package of information, <br />including copies of the NOV package, an inspection report, <br />maps, pictures and the operator June 30, 1993 request for <br />formal review. Staff said this matter related to the <br />operator's request that the Board vacate NOV C-93-026. <br />Staff said the Division inspected the site during the March 30 <br />through April 1, 1993 inspection period. Staff referenced <br />Rules 4.05.5(1)(c) and 4.05.5(2)(c) and said this NOV was <br />written for failure to design, construct and maintain sediment <br />control measures to minimize erosion, as necessary, to provide <br />protection for topsoil and vegetation and for failure to <br />retain sedimenC within disturbed areas. Staff said the intent <br />of the Regulation is to minimize offsite impacts using the <br />best technology currently available to provide protection for <br />topsoil and vegetation. <br />Staff said the NOV applied to the Grizzly Pad facilities area, <br />the east side of the upper facilities area and the outlet of <br />Culvert E-12. Staff said that an assessment conference was <br />held and that the conveyor belt was modified out of the NOV <br />during that meeting. <br />Staff referenced the Exhibit A and discussed the Grizzly Pad <br />which measures about 300 feet by 400 feet of gravel and dirt <br />surfacing. Staff said the area contains coal screens and a <br />small coal stockpile, and is surrounded on three sides by <br />reclaimed land. Staff said that drainage on the Grizzly Pad <br />is usually controlled by a system of a berm and a ditch that <br />route drainage back to the haul road, the entrance of the Pad <br />and to the west ridge pond. <br />
