Minutes, September 22-23, 1993 <br />DRAFT <br />Subject To Board Approval <br />43 <br />Staff referenced maps from Exhibit A and discussed the <br />location of the areas included in the NOV. Staff said the <br />upper facilities area measures about eight acres and is a dirt <br />and gravel yard which houses the shop, offices, warehouse, <br />maintenance shops and a coal stockpile. Staff said that at <br />the time of the inspection, snow and coal material from the <br />facilities yard had been pushed over the berm located on the <br />east side of the facilities yard. Staff referenced the <br />photographs included in the package of information and said <br />the operator's activity caused the material to be deposited on <br />undisturbed areas where topsoil and vegetation had not been <br />removed. <br />Staff discussed the violation related to Calvert E-12. Staff <br />said the culvert carries runoff from the facilities area to <br />the Moffat Haul Road Ditch System. Staff said that at the <br />time of the inspection, the culvert was plugged with coal <br />fines and mud. Staff said that a slurry of mud and coal fines <br />had flowed through the culvert and out onto reclaimed areas. <br />Staff said that topsoil and vegetation was contaminated by the <br />mud and the coal. <br />Staff referenced a map from Exhibit. A and indicated the <br />reclaimed areas on which the bond had been released. Staff <br />said the areas are now considered undisturbed. Staff said <br />that the areas of E-12 and the outslopes of the Grizzly Pad <br />where the coal was deposited were not included in the <br />operator's current plan for reclamation. Staff said that the <br />areas where the coal was deposited were clearly undisturbed. <br />Staff said abatement of the violation required that the <br />operator cleanup the cited areas, removing the coal, submit a <br />technical revision to the Division that would address of some <br />of the areas, and implement the approved drainage control <br />plan.. <br />Staff said that the required ground work was completed by the <br />time of the May 25, 1993 inspection. Staff said the operator <br />submitted a technical revision on May 20, 1993, and that the <br />Division is currently reviewing the submittal. Staff said <br />this means that the violation has not yet been completely <br />abated. <br />In response to a request from the Board, Staff discussed how <br />material was deposited in each of the three areas. In <br />reference to the Grizzly Pad, Staff said that when the snow <br />was cleared from the pad area, snow and coal from the pad area <br />were pushed up beyond the containment berm. Staff said that <br />a safety berm was also in place for the shops and facilities <br />
