Box 176 <br />Oak Creek, CO 80467 <br />All persons wishing to give testimony were sworn. <br />Secs. 19, 20, 30 and 31, TSN, R85W; Sec. 36, T5N, R86W; Secs. <br />12-14 and 23-25, T4N, R86W and Secs.7-8, 17-19 and 30, T4N, <br />R85W, 6th P.M., Routt County, 4,360 acres; surface Federal <br />coal mine. Consideration of a request to vacate NOV C-93-024 <br />issued for failure to control erosion and siltation from an <br />access road to prevent damage to public or private property <br />(continued from the August 1993 Board Meeting). <br />Ms. Cheryl Linden, the Assistant Attorney General, stated that <br />the operator had made a request that this matter be continued <br />to the October 1993 Board Meeting. She said that the Division <br />would agree with the continuance, with the following <br />conditions: 1) the operator will submit the technical <br />revision by October 7, 1993, 2) the operator will complete the <br />road, ditch and berms by October 31, 1993, as stated in the <br />technical revision, if the weather permits. <br />Staff EXHIBIT A, package of information regarding this matter, <br />and clarified that the conditions for continuance are the <br />requirements by the Division for abatement of the NOV. Staff <br />said the matter will be addressed during the October 1993 <br />Board Meeting, if an agreement has not been reached by that <br />time. <br />Mr. Dave Beverlin, - Cy representing the operator, <br />stated that the technical revision has been submitted and the <br />operator-.wants time to attempt to resolve the issues of the <br />technical revision with the Division. <br />It was MOVED that the Board continue this Item to the October <br />1993 Board Meeting.
