Ken's permit was renewed on <br />December 9, 1992. OSM'e spent a week at the DMG's off ce reviewing these permit <br />files for procedural and substantive deficiencies. The only deficiencies which the <br />resulting OSM report noted is Ken's pcaait concerned whether all of the aquifers in the <br />vicinity of the Mine had been identified sad analyzed by the DMG in the groundwater <br />hydrology section. There was no mention of pmblems regarding compliance with the <br />AOC standard or whether the backfilling and grading plan, as revised in 1990, met that <br />standard. <br />2. 'The DMG notified OSM's AFO that Kerr began the backfilling and <br />grading work in Juae,1993 snd of Kerr'a progress through January, <br />1994 by monthly inspection reports. <br />The Summary states that the AFO's inspectors expected the baclil'illing and <br />grading work to take up to nine years sad that they did not press the AOC issue because <br />they were unaware Kerr had begun the work. At the time of the April, 1993 inspection, <br />the 1990 approved plan did allow several years to complete backfilling and grading. <br />Thereafter Kar was able to aaange the equipment, work force and fineacirtg to do the <br />complete job. Work began is Juae, 1993. <br />
