Mr. Austin telephoned Mr. Price regarding the studies in late July or <br />early August, 1993. Mr. Price requested that copies of Mr. Inman'a studies be sent to him <br />so the DMG could evaluate them thoroughly. Mr. Austin responded that the studies were <br />internal documents which he could not release to the DMG without approval by his <br />supervisors, <br />COnt[ary 20 the statement in the Summary, the AF() never Bent eithe[ Study to the <br />DMG and Mr. Austin did not discuss them further with Mr. Price.t The existence of the <br />reports came up in a meeting between the DMG and Kea in early March, 1994, at which <br />Ken's prospective bond release application was discussed. Mr. Price and Mr. Berry <br />stated they had not been able to obtain the reports, but would try again. The WSC Eased <br />the reports to Mr. Beery at 2.21 p.m. on March 3, 1994. <br />OSM's AFO had another opportunity to bring any AOC concerns at Keda Mine to <br />the DMG's attention Tlu Regulatory Affairs Branch of the AFO reviewed Ken's perDnit <br />sometime is the first half of 1993 as part of its annual evaluation of Colasado's State <br />Program. Ken's permit was selected because OSM's oversight review focused on all <br />tThe Summary states: "The WSC report [Inman studies] was sent to DMG with the <br />understanding that the issue would be addressed through programmatic channels." Ken's <br />attnmeys reviewed all of the AFO'a files oa this matter oa July 6, 1994, and found no letter err <br />memo transmitting Mr. Inman's entdies to the DMG. Mr. Austin confirmed in ]tie deposition <br />that there was no transmittal dotaunent or other written con++++»*+catioa from the AFO to the <br />DMG regarding the Inman studies. He did testify, however, that he sent the studies to Mr. Price. <br />
