The Objectors presented evidence only on issues C. and E. (blasting impacts and <br /> <br /> <br />hydrologic balance issues). Because no evidence was presented on all other issues, <br />neither the Division nor the Applicant addressed them during the Formal $oard Hearing. <br />The administrative record, including the Division's Rationale for Recommendation for <br />Approval over Objections ("Rationale"), demonstrates that the Applicant has met the <br />rninimtm~ requirements of the Act concerning the issues listed in the proposed preheating <br />conference order which were not addressed by the objectors. <br />9. Issue 7(C): Impact to Off site Areas due to $lasting Auring Mining and <br />Reclamation, Rules 6.4.4(1) aad 6.5(4). Rules 6.4.4(i) and 6.5(4) require an applicant to <br />demonstrate that off site areas will not be adversely affected by blasting during mining or <br />reclamation operations- As described in testimony at the Formal Board Hearing, as set <br />forth in the Rationale, and as described in permit stipulations contained in the Division's <br />recommendation for approval, the Applicant will monitor each quarry blast with a <br />minimum of one seismograph located between the location of the blast and the nearest <br />potentially affected building or structure that is not owned or controIled by the Operator- <br />The vibrations measured by the seismograph may not exceed those set forth in the <br />blasting level chart, which is part of the record. The Operator will prepare a blasting <br />report for each shot. These reports must be retained by the Operator for at least three <br />years and be available for inspection by the Division on demand, The reports will <br />contain such information as the location, date, and time of blast; name, signature, and <br />license number ofblaster-in-charge; identification, direction and distance, in feet, from <br />HolcimlCoaldale, M-1977-247 <br />
