The Operator will provide a full report of all ground water monitoring activities by creating a
sepazate section in the annual reclamation report required under section 34-32-116, C.R.S. If
evidence of non-compliance with permit conditions protective of ground water is found, the
Operator will follow the Division of Minerals and Geology "Ground Water Compliance Protocol"
attached to this letter. If "early warning indicators" listed in attachment 1 to technical revision TR-
003 are exceeded in welts that are not designated points of compliance, then the Operator will notify
the Division within five (5) working days and cooperate in any further investigations or permit
modifications that are determined to be necessary for the protection of ground water.
3. The Operator will provide the Division of Minerals and Geology with a proposal for points of
compliance and numeric protection levels for the dissolution surface monitoring of potentiometric
pressure and temperature once the dedicated probes are installed and operational. The Operator will
also provide a proposal for a sepazate compliance protocol for the dissolution surface since
temperatures and pressures above the numeric protection limit are indicative of leakage from the
mining cavities and may require immediate corrective action. The numeric protection levels will be
based on the data collected over the thirteen-month ambient ground water study correlated with the
initial data generated by the dedicated probes. Based on the initial probe data, the Division will
determine if the incorporation of dissolution surface numeric protection levels into the permit will
be an additional technical revision filing, or a component of technical revision TR-003. In either
case, the dissolution surface points of compliance, numeric protection levels, and compliance
protocols will be binding on the Operator and enforceable components of the reclamation permit.
4. The Operator will provide the Division with a copy of the United States Geologic Survey (USGS)
sampling and analysis audit report when it becomes available and cooperate on the incorporation of
any USGS recommendations into the sampling, analysis and compliance plan or plans approved in
the reclamation permit.
If you have any questions, or wish to discuss the wording of the suggested conditions, please contact
me.
Sincerely,
Allen C. Sorenson
Reclamation Specialist
m:~w~c,w~enc,n roe, mmrm~.a~
