The technical revision is scheduled for a formal public hearing before <br />the Mined Land Reclamation Board (Boazd) on August 24, 2000. If American Soda addresses the <br />following listed adequacy items and agrees to the conditions to approval listed in this letter, the <br />Division staff will be recommending approval of the technical revision at the hearing. <br />Adequacy Items <br />Provide the Division with a potentiometric surface contour map that is updated with the most recent <br />data from the Yankee Gulch Project Monitoring wells. The map must be of a large enough scale to <br />ensure legibility. A scale of one inch to 300 feet is suggested. The map must illustrate the <br />potentiometric surface contours in both the upper and lower aquifers. Multiple maps or overlays <br />may be needed for legibility. The map must be provided sufficiently in advance of the August 24, <br />2000 hearing to allow for a thorough review by the Division of Minerals and Geology. The <br />Division suggests that the map be provided no later than August 18, 2000. <br />Sug;;ested conditions to approval: <br />Ground water in the vicinity of the Yankee Gulch Sodium Minerals Project is subject to regulation <br />through permits issued by the Colorado Mined Land Reclamation Board, the U.S. Bureau of Land <br />Management (BLM), and the U.S. Environmental Protection Agency (EPA). If BLM and/or EPA <br />requires permit conditions protective of ground water that potentially conflict with conditions <br />approved in the reclamation permit, the Operator will contact the Division of Minerals and Geology <br />(DMG) within a reasonable time and cooperate in revising the reclamation permit as necessary to <br />address any conflicting requirements. If BLM and/or EPA impose permit conditions protective of <br />ground water that differ from those in the reclamation permit, but aze not necessarily in conflict, the <br />Operator will contact the DMG within a reasonable time and cooperate in the determination as to <br />whether or not revision of the reclamation permit is necessary. <br />
