GROUND WATER COMPLIANCE PROTOCOL <br />1. The Division will be notified immediately of any evidence of possible noncompliance with ground water <br />permit condition(s) and a copy of the analysis of the sample showing the possible noncompliant <br />condition will be provided to the Division within 5 days of its receipt by the Operator. <br />2. The initial verification sample would be taken within 2 weeks of the receipt of the analysis showing the <br />possible noncompliance. <br />3. The second verification sample would be taken within 2 weeks of the receipt of the analysis of the initial <br />verification sample, if evidence of possible noncompliance with the peanit condition(s) persists. <br />4. If compliance with the pemut condition(s) is demonstrated by either of the verification samples, the <br />Division will conclude that noncompliance with the pemut condition(s) has not occurred and regulaz <br />monitoring of the compliance well would be resumed. <br />5. If compliance with the permit condition(s) has not been demonstrated by either of the verification <br />samples, then the Division will consider the extent and nature of the non-compliance and determine the <br />enforcement action to be taken. <br />6. If evidence of the possible non-compliance persists through the second verification sample, the Operator <br />will provide to the Division, within 30 days of the receipt of analysis of the second verification sample, a <br />permit revision adequate to bring the mine into compliance with the permit condition(s) that are not in <br />compliance. <br />
