On September 21, 2004, the Division denied this
request on the basis that the "reclamation had not been accomplished on these areas..."
Continental Materials Corporation and Transit Mix of Pueblo, the latter being the actual operator
o:f the pit and a wholly owned subsidiazy of Continental Materials Corporation, wishes to request
an appeal of that denial. Included with this mailing is information that describes the basis for this
appeal request. The documents detail the arrangements between the new landowner, Colorado
State Parks, and us. Note that Parks requires a number of items be completed prior to
consideration of release by DMG and other tasks that will be ongoing, under the supervision and
direction of Pazks, until May 4, 2006. This especially applies to weed control. Essentially, it is
our belief that with the agreements in place that property being managed by a State agency
release is a safe action that can be taken by the Mined Land Reclamation Board.
If you have any questions regarding the site or the materials included in this release request,
please call.
Respectfully submitted,
l 1 -
Gerald Hermans
Vice President
P.0.
