t_ <br />Request for Release <br />Appeal of Denial <br />Pueblo West Pit <br />M-1977-573 <br />Background: On August 27, 2004, Continental Materials dba Transit Mix of Pueblo, requested a <br />release of a lazge parcel of permitted land at their Pueblo W est Pit. This operation is completed with <br />mining, the plant has been completely removed, and only the mined land north of the Arkansas River <br />remains to be placed in final reclamation status. On September 21, 2004, the Division denied the <br />request on the grounds that the reclamation had not been completed on all the lands included in the <br />request. Although there is no disagreement regarding [he lack of full completion of the land included in <br />the request, it is the belief of Continental Materials that other matters need to be taken into <br />consideration. Therefore, this appeal to the denial has been filed for consideration by the Mined Land <br />Reclamation Board. <br />Future Land Use Plans: The land included in this request has been purchased from Valco, Inc. by <br />the State of Colorado and more specifically Colorado State Parks. Lake Pueblo State Park is located a <br />short distance west of this site and there is a Division of Wildlife area just west of the site. In fact, some <br />of the lakes on the west end of the operation (on land that was previously released) are frequented by <br />fishermen and bird watchers. At present there aze no definite plans to develop the land included in the <br />release request, but its utility for wildlife habitat and potentially for an extensive recreation facility are <br />obvious. The azea is moderately isolated from human uses and is therefore heavily used by water birds <br />during the winter and spring. Adjacent forest areas also add to its attractiveness for wildlife. In addition <br />the high quality water in the lakes and shoreline wetlands make these areas suitable for establishing <br />large aquatic wildlife populations. Clearly, State Parks would not have purchased this land if there was <br />no intention of developing it as, at least, a wildlife habitat with limited foot access. <br />In addition to these qualities, during the winter of 2004/2005 the adjacent Arkansas River <br />channel will be extensively upgraded with regazd to its fisheries habitat. This project is primazily <br />funded by the U. S. Army Corps of Engineers. A previous release request of unaffected land along the <br />river corridor was approved so this project might move forwazd without an additional layer of <br />regulatory oversight. This project not only includes the river in this azea, but essentially the entire <br />Arkansas River corridor through Pueblo. The Ciry of Pueblo has been heavily involved in that project <br />as it is a significant addition to their already well developed riparian corridor recreation area. <br />Flppeal of Denial -Pueblo West Pit M-1977-573 mailed: September 30, 2004 Page <br />
