In response to the problems (#3) listed in your report of an inspection done at the Rifle
Pit on May 20, 2003, Mr. Bill Bailey, United Comma s' Rifle area Manager contacted
the attorney that is handling the nentation Plan applicatio ~n Water Court to get a
letter explaining the status of the Ruling. As you can see 1 M Snodgass' letter to Mr.
Bailey the Ruling of the Referee is in hand and the water rights claimed have been
confirmed and adjudicated. A copy of Mr. Snodgrass' letter and the last page of the
Ruling of the Referee are attached.
At this time, United Companies will be making an application for the Well Permit for the
MMM/Chambers Pit based upon the conditional water rights found in this Ruling of
Referee. Also, we will be working with the Water Commissioner and State Engineer to
implement the water augmentation plan that was proposed for the Referee's
consideration.
Does this Ruling of Referee relieve us of the requirements, cited under Problem #1 of the
May 22, 2003 Inspection Report, to submit a Technical Revision showing the area mined
and a source of fill for the gravel pit?
