This proceeding has now been favorably concluded, and the water <br />rights claimed in the application have been confirmed and adjudicated as conditional <br />water rights. <br />In order to keep these conditional water rights in full force and effect, you <br />must proceed with diligence to develop these water rights. The statute defines <br />diligence as the "steady application of effort to complete the appropriation in a <br />reasonably expedient aJtd efficient manner under all the facts and circumstances." <br />You shotdd take concrete actions in the next six years to develop these rights, and, <br />if possible, you should try to complete the appropriation of these rights during this <br />time period. If diligent efforts are not made to develop these rights, you risk losing <br />these rights. <br />Cue important step that you need to take iu decel~ping these rights is to <br />file a well permit application for the Custom Crushing Pits with the State <br />Engineer in the near future. Please let us know if you wish us to prepare and <br />file the well permit application on your behalf.
