<br />5. Petitioners urge the following in reconsideration of the action and <br />decision of the Mined Land Reclamation Board: <br />5.1 The Gold Hill Ventures Limited Partnership was succeeded as <br />the permit operator by Gold Hill Ventures (a Colorado Mining Partnership) and <br />Colina Oro Molino, Inc., (a Washington corporation) on October 18, 1991. On <br />that date, the Gold Hill Ventures Limited Partnership was relieved of all <br />responsibilities concerning this operation (see Mineral Rules and Regulations <br />Number 1.7). <br />5.2 Neither the Gold Hill Ventures Limited Partnership or Gold <br />Hill Ventures (a Colorado Mining Partnership) willfully or deliberately violated <br />the terms and conditions of the Cash Mine Permit No. M-83-141 (as amended) <br />by processing ores from the Bueno and Cross mines in the Gold Hill Mill. <br />5.3 Colina Oro Molino, Inc., and Homestate, Inc., were in <br />possession and were the sole operators of the Gold Hill Mill during the last <br />~ eighteen months. Colina Oro Molino, Inc., and Homestate, Inc., were solely <br />responsible for the purchase and importation of ores from the Bueno and Cross <br />mines for the purpose of processing said ores in the Gold Hill Mill. <br />5.4 At no time did the Gold Hill Ventures Limited Partnership or <br />Gold Hill Ventures (a Colorado Mining Partnership) participate in any of the <br />milling operations conducted by Colina Oro Molino, Inc. and Homestate, Inc. in <br />the Gold Hill Mill. <br />5.5 The Gold Hill Ventures Limited Partnership and Gold Hill <br />Ventures (a Colorado Mining Partnership) did not engage in any activity that <br />willfully and deliberately violated the terms and conditions of the Colorado <br />Mined Land Reclamation Act, and have always urged our co-permittee to comply <br />with terms and conditions of the Cash Mine Permit No. M-83-141. <br />5.6 The Milling Contract dated February 13, 1991, between the <br />property owners and the owners of record of the land included in the Cash Mine <br />Permit No. M-83-141 (as amended) required that "Each party shall bear sole <br />4 <br />
