Gold Hilt Ventures (a <br />Colorado Mining Partnership) relied on its co-permittee Colina Oro Molino, Inc. <br />to conform and comply with the terms and conditions of the Cash Mine Permit <br />No. M-83-141 (as amended), and should not be held responsible for Colina Oro <br />Molino, Inc. and Homestate, Inc.'s interpretation of those terms and conditions. <br />5.7 The record shows that Gold Hill Ventures (a Colorado Mining <br />Partnership) through its legal representatives and agents has repeatedly and <br />consistently urged its co-permittee Colina Oro Molino, Inc. to operate the Gold <br />Hill Mill in accordance with the terms and conditions of the Cash Mine Permit <br />No. M-83-141 (as amended), and that every effort was made by Gold Hill <br />Ventures to bring Colina Oro Molino, Inc. into compliance with the Colorado <br />Mined Land Reclamatian Division rules and regulations. <br />6. Conclusion: <br />6.1 The Gold Hi11 Ventures Limited Partnership and Gold Hill <br />Ventures (a Colorado Mining Partnership} did not willfully or deliberately violate <br />the terms and conditions of the Cash Mine Permit No. M-83-141 (as amended). <br />6.2 Gold Hill Ventures (a Colorado Mining Partnership) relied <br />upon the good faith and professional abilities of their co-permittee (Colina Oro <br />Molino, Inc.) to operate the Gold Hill Mill in conformance with the rules and <br />regulations of the Colorado Mined Land Reclamation Division. <br />6.3 The violation of the permit for which the Colorado Mined <br />Land Reclamation Board has imposed a civil penalty in the amount of $23,370.00 <br />was solely the result of activities conducted by Colina Oro Molino, Inc. (the <br />co-permittee) and Homestate, Inc., (a Washington corporation), and were <br />activities that were beyond the control of Gold Hill Ventures (a Colorado Mining <br />Partnership). <br />6.4 Gold Hill Ventures (a Colorado Mining Partnership) was <br />brought before the Colorado Mined Land Reclamation Board for permit <br />violations that it did not commit, and which the record shows it had no control <br />5 <br />
