PAGE 3 <br />May 16, 1997 <br />On way to accomplice this if for Siloam Stone to apply for a <br />Special 111 Permit based on the contract they have with Brecken- <br />ridge. This contract cover supplying stone they use to armor and <br />beautify the Blue River corridor as it flows thru town. If this <br />approach is acceptable, we would start the conversion process as <br />soon as possible so we have a permit to supply our other custom- <br />ers with the smaller rock we sell. The questions we have for the <br />Board are: <br />Can we get a Special ill permit for the area where the slab <br />stone is and then convert it to either a Limited Impact <br />(110) or Regular (112) permit later? <br />If the 111 permit is acceptable, have we addressed the <br />Boards Order and the Cease and Desist order and will the <br />remaining $60,000 fine be revoked? <br />AREAS TO BE RECLAIMED <br />These areas are shown on the map with parallel line hatching. As <br />you will note the lines run east-west in two areas; north-south <br />on one; and slanted on the last. We did this for sake of clari- <br />fication in discussion. The east-west hatched areas (2.59 ac. ±) <br />are where Siloam Stone sorted and pelletized the stone it removed <br />from the mining operation. The material was hauled to these <br />sites and piled in rows so the marketable stone could be sepa- <br />rated and placed on pallets for shipping. Review of the site <br />suggests the grasses that were crushed last summer are beginning <br />to return now and if left undisturbed thru the summer will fully <br />recovered without any other actions. Removal of the windrows and <br />pallets will begin when this plan is approved. once the windrows <br />and pallets are removed the areas will be final graded and seeded <br />in the fall with the seed mix approved in the Siloam Mine permit. <br />The north-south hatched area is where Siloam Stone was removing <br />rock from a waste rock pile established prior to the law taking <br />affect. This pile was reduced from nearly 20 feet tall to being <br />level with surrounding area now. By removing this pile Siloam <br />was actually reclaiming a pre-law disturbance area. This does <br />not excuse what they did, but their actions were not as destruc- <br />tive as if they were excavating. The open circle on the 2.2 <br />acres area identifies a convenient existing hole that needs to be <br />filled. It is important to remember that this area was in a pre- <br />law disturbance area where there was no topsoil. We also have to <br />shape the nearly vertical south slope of the topsoil pile in this <br />I area. We propose to use part of the west end of this topsoil <br />j pile (approximately 0.61 ac ± block lined) to provide the soil <br />
