PAGE 2 <br />May 16, 1997 <br />We have designated three activities that must be addressed under <br />the Board Order. <br />STONE YARD <br />This area is located on the south part of the map (2.91 ac. ±) <br />and it is not part of any particular mining operation. The area <br />has been and will continue to be used as an assembly area of <br />various stone products Siloam Stone sells. While they have a <br />stone yard in Canon City and the need for an assembly yard is <br />necessary near the source. Most of the rock currently in this <br />area came from the adjoining mine. However, Siloam Stone has <br />been negotiating with other mining operations in the area to <br />purchase their stone products to offer for resale. A near <br />working relationship with at least two mine operators allow for <br />stone to be hauled to this site for sorting and distribution. <br />Once the yard is fully utilized a new access road will be built <br />directly from Siloam Road to the yard. According to CRS 34-32.5- <br />109(2) this area is not defined as a "MINING OPERATION" since the <br />law specifically reads; "The term does not include concentrating, <br />milling, evaporation, cleaning, preparation, transportation, and <br />other off-site operations not conducted on the affected lands." <br />The stone yard is a cleaning and preparation area that obtains <br />rock from various sources. This area is also an approved non- <br />conforming land use area where this activity is allowed according <br />to the Pueblo County Planning Department. Attached is a copy of <br />a letter from Mr. Phil Shafer confirming this. <br />We area asking that this Stone Yard area that is used for dis- <br />play, processing, preparing, shipping and sale of stone be <br />exempted from needing a permit or being under Mined Land Reclama- <br />tion Board jurisdiction. We may also expand its size as demand <br />for stone increases. <br />LARGE SLAB ROCK SOURCE <br />These two areas cover 1.85 acres ± (++ filled on map) of the <br />disturbed area. The eastern parcel is where Siloam was removing <br />thick pieces of waste rock from a pre-law disturbance area. The <br />western parcel is where large pieces of thick slab rock were <br />removed to supply material for a contract with the Town of <br />Breckenridge Colorado. Once Siloam found out that they could not <br />do this they replaced the topsoil over the disturbed area on the <br />west side so it is ready for seeding. However, Breckenridge <br />still needs rock so these two areas will be included in the <br />permit for which we will apply. Siloam Stones contract, with <br />Breckenridge requires rock to be delivered to them from May 1, to <br />October 1, 1997, so we need to get a permit immediately. <br />
