i` <br /> <br />III. Comments - Compliance <br />Below are comments on the inspection. The comments include discussion of <br />observations made during the inspection. Comments also describe any <br />enforcement actions taken during the inspection and the facts or evidence <br />supporting the enforcement action. <br />General Kline Comuliance <br />Colorayo is acting within their current mine plan but will submit a <br />revision to the Division on changes expected as a result the new dragline <br />coming on line. <br />Wildlife <br />Deer and elk sighted; primarily in undisturbed moutxtain shrub habitat. <br />Golden eagles, red-tailed hawks and rabbits also observed by inspectors. <br />Operator reports seeing up to seven golden eagles feeding together. <br />Controlled hunting is allowed on portions of Colowyo property. <br />Revedetation <br />The operator was seeding portion of Section 11 c•eclamation during our <br />inspection. Revegetation appears to be going well with the exception of <br />meeting current woody plant stem density standards. Jim Niger reports <br />that the mine is experimenting with several small projects to increase <br />woody stem density, including the use of shrub-fox•b strip plantings and <br />the the i'encing of transplanted mature shrub clumps. <br />Excess Spoil Fills <br />The lower portion of Streeter Fi11 was walked. The rest of Streeter Fill <br />was visually inspected from above. No problems were noted. <br />Ed Moyer of Colowyo gave the inspectors a thorough briefing and fieio <br />tour of current construction of the Section 16 Fill. Excavation of the <br />fill was nearing completion during our visit. All clay material is being. <br />removed from the toe of the fill, which is being excavated down to' <br />bedrock according to the Operator*. ~o significant groundwater has been <br />ercot~ntered at the fill site; only a single small wet spot having been <br />encountered tc date. vo seepage has occurred according to operator and <br />none was observed by the inspectors. <br />Material for the drain will be gravity sorted from a sandstone lens to <br />the east and tixen selectively placed by the operator for its entire <br />length. <br />a change has tab:en place in the fill design during its construction. the <br />primary change is that the location of the drain has been movea to the <br />southwest from its original placement due to changes in subsurface <br />geology and sediment depths Ivis a vis those predicted during planning; <br />encountered ~3nring construction.
