Mine Company ~ ,30'}C 7~ 2 <br />Gunnison, Colorado 81230 <br />RE: Possible violation - operating without a Mining and Reclamation <br />Dear Mr. Weaver: <br />The O.C. Mine has been operated coatimtously since the passage of the <br />ColoradooMined Land Reclamation Act in 1976. Tha deadline for all minas <br />to receive permits under the Act was October 9, 1977. The company was <br />contacted by our office this past summer and applieat;munmateriale were <br />provided. No applications material were ever received by thla office. <br />This matter will be brought to the attention of the Colorado Mined Land <br />Reclamation Board as a possible violation under Section 34-32-109 of <br />the Colorado Mined Land Reclamation Act. The range of actions available <br />to the Board include the issuance of a notice of violation, a cease and <br />desist order and the imposition of a civil penalty. The Division of Mined <br />Land Reclamation coneidero this to be a serious matter and recommends that <br />representatives of O.C. Coal Company be present at the December 20-21 Board <br />meeting to be held at 9:00 a.m. in room 110, Centennial Building. 1313 <br />Sherman St., Denver, Colorado. A goad approximation of the time your <br />case will be heard will be available oa Tuesday December 19th. <br />Please feel fsee to give me a call if you have any questions or require <br />additional information.
