December 28, 1978 <br />Bob Beauchamp <br />U.S. Resources, Ins. <br />4560 Belt Line Tload Suite 300 <br />Dallas, Texas <br />Dear Bob, <br />This is a formal notification of action taken by the :tined Land Recla- <br />mation Board regarding the OC62 Coal Tsine. Ae you know, the Board <br />found the mine in violation of C.R.S. 1973, 34-32-109(4) which relates <br />to operating a mine without a permit. The Board requested that a Cease <br />and Deaiat Order be issued but that the effective data of the order <br />be deferred to ?iarch 1, 1979. The Board also levied a $300 civil penalty <br />You should know, that there is an appeals procedure set forth in the <br />Colorado Administrative Procedures Act. On March 1, 1979 the Eoard will <br />hear a presentation of your application for a permit. The permit will <br />either be approved or denied. If denied, the Cease and Desist Order <br />}ndoubtedly will be imposed. <br />For your information, the specific motion approved by rho Board follows: <br />?LOVED that the Board finds that the OC 42 :fine, operated by :iacar <br />Inning Corporation, has been operating an underground coal mine <br />c~ibLout a permit and therefore 3e in violation of 109(4) and <br />that a Cease b Dosist Order bo issued (effective date of such <br />order to be deferred to `larch 1, 1979), during the period of <br />such time, the operator ie instructed to submit an application <br />for n permit in each form and aubetance that it meats the <br />requirements of the law and that no further surface disturbance <br />ieato occur at the mine site pending approval of said application. <br />SECONDED b PASSED <br />It was further <br />MOVED that on the basis of having found OC C2 7~[ine in violation, that <br />a civil penalty of $300 be set on the baAia of at least cis (6) <br />days of oppration in violation at $SO per day. <br />SECONDED 6 PASSED <br />We will be looking fon+ard to receiving your permit application. <br />Sincerely, <br />Director <br />Hamlet J.
