Q And then you were the chief of his branch doing an <br />evaluation on how he was doing the inspection? <br />A That is correct. <br />Q So, you weren't actually inspecting. <br />A In literal terms, no, sir. <br />Q Is it your understanding that [Inspector Austin] <br />reviewed the permit documents in the Albuquerque <br />Office in preparation for that inspection? <br />A Yes, sir. He was able to review some of those <br />documents. <br />Q And did he--included in those were the backfilling <br />and grading plan and final topography plan? <br />A I know that some review was done on the <br />backfilling and grading sections. Exactly what <br />sections, I'm not sure. <br />Q Okay. Furthermore, is it your understanding that <br />he discussed that with DMG at the mine and the <br />operator at the mine? Again, this is the 1993 <br />inspection. <br />A We had discussions about backfilling and grading, <br />yes, sir. <br />Q who did you have discussions with? <br />A We had discussions about backfilling and grading, <br />not necessarily AOC. Those discussions were with <br />the operator's consultant, Jerry Nettleton, and <br />also George Patterson, the operator--and the <br />State, who, at that time, was Dave Berry and <br />Randall Price. <br />Q Okay. Were those concerns about--what were these <br />concerns about backfilling and grading? <br />A Contemporaneous reclamation, for the most part. <br />Q Who had identified those concerns? <br />A Henry Austin. <br />4 <br />
