Q you didn't do any preparation for that <br />inspection, as to the substance of the permit for <br />the Marr Strip Mine? <br />A No, sir. <br />Q Now, did those discussions involve a review of the <br />backfillinq and grading plan as to--and the final <br />configuration maps--for the Pit 1 area? <br />A I don't believe so, sir. <br />Q So that wasn't discussed at that point, correct? <br />A I don't recall that it was. <br />Q Just the pace of reclamation. <br />A That was the main point of discussion; yes, sir. <br />Tr., 158-63. <br />Obviously, the record is unclear on what Inspector Austin <br />was able to review in preparation for the March/April 1993 <br />oversight inspection. Inspector Rathbun knew only that Inspector <br />Austin reviewed "some" plans and maps concerning backfillinq and <br />grading, but he was not sure about "exactly" what was reviewed. <br />Tr., 160. In any event, the AOC issue was never, during the <br />March/April 1993 inspection, raised or discussed by or between <br />anyone. Tr., 163. That fact is consistent with Inspector <br />Rathbun's testimony that he was unaware of the AOC problem until, <br />over a year later, he reviewed Kerr's revised 1990 permit and <br />~ AFO was not directly involved in the permit review <br />process under the Colorado program. Tr., 53. AFO's files on <br />Kerr's permit contained only "incomplete" copies of the mining <br />and reclamation plans approved by DMG. Tr., 49. Also, those <br />copies were generally sent to AFO by Kerr; DMG "rarely" supplied <br />plans "for the majority of the mines in the State of Colorado." <br />Tr., 49. <br />5 <br /> <br />
