cover on above-ground portion, preparation plant (DWG 379-17- <br />FDI), clean coal screening, conveyor and cover, snorkel, clean <br />coal stockpile, refuse conveyor and cover, refuse bin." The <br />permit requires the clean coal stockpile not exceed 10,000 tons <br />at any one time. Energy Fuels estimated the amount of coal in <br />the stockpile at the time of the inspection to be approximately <br />30,000 tons, which is well in excess of the amount allowed. As a <br />result of this MLRD issued Notice of Violation number C-91-32 for <br />a violation of Rule 4.17, <br />SPCC Plan: The plan indicates that there is immediate containment <br />of all fuel and oil storage tanks, should a spill occur, by means <br />of grouted block walls. The secondary backup for a spill would <br />be one of the impoundments which is located in the area. The <br />block wall around the stoker oil tank had two blocks broken loose <br />in one corner making the wall ineffective as a containment <br />devise. Sedimentation pond 5 is the backup structure for the <br />stoker oil tank, however this impoundment does not have an oil <br />skimmer and cleaning the pond would only pose additional problems <br />should it be used as a backup. There was a collection of 55 <br />gallon drums to the west of the portal that contained some oil <br />and other substances which were not identified. There was an <br />earthen berm around the area but it had deteriorated to the point <br />that it would not be effective should a spill occur. MLRD has <br />instructed the company to make necessary repairs and to update <br />their plan. <br />Certifications: <br />Impoundments- At the mine ponds 1, 2 and 3 were certified in <br />September 1987. Ponds 4 and 5 were certified in September <br />and July of 1984. Pond #1 at the loadout was certified in <br />March 1990 and pond #2 at the loadout was certified in April <br />1983. It was noted that ponds 2 and 3 at the mine had not <br />been inspected during the quarter. This was done prior to <br />the end of this inspection. <br />Diversions- The refuse area permanent diversion ditch #1 was <br />certified 10-2-90. <br />The north refuse ditch, sections A, B and C were certified <br />10-2-90. <br />The south refuse ditch, sections C and D were certified 10- <br />2-90. <br />The west refuse ditch, sections A, B and C were certified <br />10-2-90. <br />The Magpie creek diversion was certified as an existing <br />structure 1-26-90. <br />Roads- None of the roads at the mine site are considered <br />haul roads and therefore are not certified.
