application and the Applicant Violator System was not correct as <br />to company officials and directors or ownership of other <br />companies and mines. MLRD issued Notice o£ Violation number C- <br />91-34 for a violation of section 2.03.9 (3) (d) of the <br />regulations requiring the company to submit correct information <br />by 1-16-92. <br />Bond: The bond for this mine was found to be irrevocable letter <br />of credit 12684 issued by Bank One of Texas in the amount of <br />$811,000.00. The issue date was 3-10-91 and the expiration date <br />is 10-1-92. <br />Blasting: Blasting records consisted of permit #65 issued by <br />Fremont county which allowed storage and use of explosives. All <br />detonation of explosives occurs underground and no other records <br />are required. <br />NPDES or discharge permit: Two discharge permits are currently <br />held by the company for this permit. Discharge permit number CO- <br />0036595 covers the mine and facilities and has four discharge <br />points. The expiration date is 9-30-96. Discharge permit <br />number COG-850006 covers the train loadout area and has two <br />discharge points. The expiration date of this permit is 6-30- <br />92. It was noted that the minimum pH for one of the discharge <br />points under permit CO-0036595 was exceeded without an <br />explanation from the company as is required by the NPDES permit <br />(6.5 was the minimum pH under the permit, the sample was 6.2). <br />No other discrepancies were noted for samples taken during the <br />past four quarters. <br />Water monitoring: The surface and groundwater monitoring report <br />for the last quarter as well as the annual hydrology report was <br />reviewed. it was noted that the company was not testing pH in <br />the field. MLRD will request Ghat this be done. <br />Air quality monitoring: There are eight air quality permits <br />issued by the Colorado Department of Health, covering different <br />sections of the mine. Permit 12FR370(F)-1 covers the portal <br />conveyor, raw coal stockpile and telescoping snorkel tube. It <br />was noticed during the inspection that part of the cover on the <br />portal conveyor was missing. The company stated that this <br />occurred during a recent wind. The permit requires the conveyor <br />to be covered. <br />Permit 12FR370(F)-2 covers the "Reclaim feeder and conveyor with <br />
