~ not shown on drawings. Section B of the North refuse ditch <br />needed maintenance which was started during the inspection but <br />was not completed due to ground conditions. As a result of the <br />above MLRD issued Notice of Violation number C-91-29 for <br />violations of Rule 4.05.3(1)(e), 9.03.2(9), 4.03.2(4)(e)(i), <br />4.10.3(2) and 9.09.2(7). The areas covered by the N.O.V. are as <br />follows; <br />1. Failure to maintain ditches and sedimentation traps: <br />A-Section B of the North Refuse ditch. <br />B-Steep portion of the access road leading up to the refuse <br />pile. <br />C-CD-1, CD-2 and CD-3. <br />D-Railway containment berm, west loadout. <br />E-Perimeter ditch west loadout area. <br />F-Perimeter ditch on the north side of east loadout area. <br />G-Sedimentation trap SE of sedimentation pond L1. <br />H-Erosion protection on N-S portion of perimeter ditch at the <br />east loadout area. <br />2. Failure to design ditches and sedimentation traps: <br />A-Ditch along the south side of the access road leading between <br />the wash plant and the storage bench west of the portals. <br />B-Ditch running along the north side of the railroad track in <br />the east loadout area. <br />C-Lower reach of the north perimeter ditch in the east loadout <br />area. <br />D-Sediment trap on the southwestern corner of the east loadout <br />area. <br />E-Ditch running southeast of the railroad track in the wide <br />flat area. <br />3. Failure to design culverts: <br />A-Culvert from the yard area catchment basin, #36 on map 12. <br />B-Culvert on west side of road on the upper terrace gate above <br />the west loadout. <br />4. Failure to maintain culverts: <br />A-Inlet of culvert #90 on map 12. <br />B-Lowest culvert on west side of county road 79. <br />C-Uppermost culvert on the northwestern side of the west <br />loadout area. <br />Diversions: The Magpie creek diversion and the permanent <br />diversion at the refuse area both appeared to be functioning <br />properly at the time of the inspection. <br />Impoundments: Sedimentation pond #1 had exceeded the sediment <br />storage capacity by 1.76 feet. Cleaning of the pond had been <br />started approximately two months prior but little progress has <br />
