The inlet area of the pond has undercut a cem~nt slab <br />by several feet and this condition has been noted in quar~e rly <br />pond inspections for the past year without any repair bei g <br />attempted. <br />Sedimentation pond 9 had ice frozen on the surface of the water <br />at the time of inspection. By breaking the ice at the sp llway <br />it appeared the sediment level was above the cleanout poi t. It <br />was later found the pond had been cleaned in June of 1990 and the <br />company says that the area around the spillway was avoide so <br />damage would not be done to the spillway. Since the actu 1 level <br />of the sediment could not be determined except at the edg s of <br />the pond no action will be taken. The eastern emergency pillway <br />on the pond consist of a culvert which had been crushed a the <br />inlet. This appeared to be due to the small amount of ma erial <br />covering the culvert. <br />Due to the above findings MLRD issued Notice of Violation number <br />C-91-31 for a violation of Rules 4.05.6(3)(a), 4.05.6(3)( ), <br />4.05.9(6), 4.05.6(3)(c) and 4.05.7 which covered the clea out and <br />repair to the inlet on pond 1 and the emergency spillway n pond <br />4. <br />In addition to the above, Notice of Violation number C-91 30 was <br />issued by MLRD for violation of Rule 9.05.6(3)(d). This .O.V. <br />applied to ponds 1, 2, 3, 4, 5, L1 and L2. Due to a rule change <br />all mines in Colorado had been given notice to replace <br />combination spillways with either a principal and emergen y <br />spillway or a single open channel spillway or documentati n that <br />the pond could contain the 25 year, 24 hour event. Energ Fuels <br />had not complied with this request. <br />With the exception of the above no other problems were noted with <br />the impoundments at the mine. <br />Siltation structures: A sediment trap shown on map 13 whi <br />should have been located at the southeast corner of the e <br />loadout had been removed and no treatment existed for the <br />above where the trap had been. MLRD issued Notice of Vio <br />number C-91-35 for a violation of Rule 9.05.2(1). <br />A sediment trap located at the southwest corner of the ea <br />loadout was not designed or shown on any drawings. This <br />included under Notice of Violation C-91-29. <br />Discharge structures: None of the impoundments were disch~ <br />at the time of the inspection. <br />
