AZURITE, Inc. <br />10001 County Road 12 <br />PO Box 338 <br />Cotopaxi, CO 81223 <br />719-942-4178 <br />Fax : 719-942-4178 <br />September 13, 2006 <br />Mr. Tim Byrne <br />Colorado Lime <br />13800 Monfort Drive <br />Suite 330 <br />Dallas, TX 75240 <br />Deaz Sir, <br />Colorado Marble, Inc., has recently applied to the Colorado Division of Minerals and <br />Geology for a conversion of their reclamation permit type 110 to a type 112 regular <br />construcfion materials permit for their Lilly Mines pit located north of Garfield, CO, in <br />Section 22, Township 50 North, Range 6 E, NMPM, in Chaffee County, Colorado. <br />The Lilly Mines borders Colorado Lime patented mining claims located in Section 22, <br />patented claim #4488 The Shamrock and #4487 The Major . During a recent survey of <br />the properties included in the permit area and adjacent land owners, it was co~rmed that <br />a small area of land (35' x 250') within your Shamrock patented mining claim had been <br />disturbed by a former miner/contractor for road construction to access adjacent Colorado <br />Mazble, Inc., mining property. Due to the fact that road construction crosses over Taylor <br />Gulch drainage and the recent confirmafion of ownership, Colorado Mazble, Inc, would <br />prefer to reclaim the road cut disturbance on Colorado Lime property and not include the <br />disturbed ground within their permitted area. The Mined Land Reclamation Board has <br />directed Colorado Marble to include all recently disturbed lands within the new permit <br />boundaries or reclaim any disturbed land not included within the new permit area. <br />Colorado Mazble, Inc., commits to backfilling, topsoiling, seeding, and mulching in <br />accordance with their mining and reclamation plan, to return the disturbed area (.2 acre) <br />to its original status. Colorado Mazble requests your confirmation of this commitment <br />and a formal statement to the Colorado Division of Minerals and Geology that Colorado <br />Lime does not wish to grant access to the disturbed land for any purpose other than <br />reclamation activities. An ownership map showing the land boundaries as defined by a <br />2005 land survey of the area and the .2 acre pazcel in question is included for your <br />reference. As of the writing of this letter, the former road cut has been backfilled, <br />topsoiled, and seeded. This reclamation work has not changed accessibility to your <br />mining claims from Forest Service Road 228, which crosses the southern portion of your <br />Shamrock mining claim. <br />
