AZURITE, Inc. <br />10001 County Road 12 <br />PO Box 338 <br />Cotopaxi, CO 81223 <br />719-942-4178 <br />Fax : 719-942-4178 <br />October 19, 2005 <br />Colorado Lime <br />13800 Monfort Drive <br />Suite 330 <br />Dallas, TX 75240 <br />Deaz Sirs, <br />Colorado Marble, Inc., has recently applied to the Colorado Division of Minerals and <br />Geology for a conversion of their reclamation permit type 110 to a type 112 regular <br />construction materials permit for then Lilly Mines pit located north of Garfield, Cq in <br />Section 22, Township 50 North, Range 6 E, NMPM, in Chaffee County, Colorado. <br />The Lilly Mines borders Colorado Lime patented mining claims. During a recent survey <br />of the properties included in the permit area and adjacent land owners, it was confirmed <br />that a small azea of land (35' x 250') within your Shamrock patented mining claim had <br />been disturbed by a former miner/contractor for road construction to access adjacent <br />Colorado Mazhte, Inc., mining property. Due to the fact that road construction crosses <br />over Taylor Gulch drainage and the recent confirmation of ownership, Colorado Marble, <br />Inc, would prefer to reclaim the road cut disturbance on Colorado Lime property and not <br />include the disturbed ground within their permitted area. The Mined Land Reclamation <br />Board has directed Colorado Mazble to include all recently disturbed lands within the <br />new permit boundaries unless the land owner refuses access to the disturbed area for <br />purposes related to mining. Colorado Marble, Inc., commits to backfilling, topsoiling, <br />seeding, and mulching in accordance with their mining and reclamation plan, to return <br />the disturbed area (.2 acre) to its original status. Colorado Marble requests your <br />confirmation of this commitment and a formal statement to the Colorado Division of <br />Minerals and Geology that Colorado Lime does not wish to grant access to the disturbed <br />land for any purpose other than reclamation activities. This statement will release <br />Colorado Mazble from the action as directed by the Mined Land Reclamation Boazd <br />regazding the aforementioned land not currently owned or leased to Colorado Mazble but <br />does not change Colorado Marble's commitment to reclaim said land as described above. <br />An ownership map showing the land boundaries as defined by a 20051and survey of the <br />area and the .2 acre pazcel in question is included fot your reference. <br />Thank you for your time and attention to this matter. <br />Kenneth S.
