AGREEMEN'T' TO RECLAIM DISTURBED LANDS <br />U.S. Lime, ownec of mining claims Shamrock (#4488) and Major(#4487), located in the <br />east half of Section 22, Township 50 North, Range 6 East, NMPM, Chaffee County, CO., <br />agrees to allow Colorado Marble, Inc., owner of mining claims bordering the Shamrock <br />claim, to reclaim a 0.2 acre parcel of land within the Shamrock claim which was <br />disturbed for purposes of road construction to access Colorado Marble's active mining <br />lands. Shamrock claim lands will remain outside of Colorado Marble's new affected land <br />boundaries and will not be disturbed by future Colorado Marble mining activities. <br />Colorado Marble commits to the maintenance and care of said parcel to achieve <br />reclamation standards applicabte by the State of Colorado Division of Reclamation, <br />Mining, and Safety and to the satisfaction of U.S. Lime. The former road cut on said 0.2 <br />acre parcel has been backfilled, compacted, top-soiled, and seeded with a native grass and <br />forb seed mixture, suited for high elevation, to conform to site wide reclamation <br />practices. <br />Colorado Marble also agrees to identify and include sufficient bond money in its <br />reclamation bond total to insure that this parcel will be maintained and monitored until <br />the land is considered successfully reclaimed by the State authority and by U.S. Lime. <br />~~ <br />Agreed upon, this ~'~ay of March, 2007.
