David Berry - 2 - April 7, 1998
on March 26, 1995. The flow which emerged from the 3rd west seals in June of
1995 was undeniably a "mine inflo~Y'. The solid coal pillar between the Bear No.
3 Mine and MCC's mine took on additional weight after Bear pulled pillars in the
3`d west mains. This fact could partially account for the sudden unexpected flow
from the 3`d west seals two to three months after the 3'd west mains were pillared
and sealed.
2. DIL4G -Please describe, in detail, the nature of flo:vs observed in the 3r° West
Section of the Bear lt,ine. You have indicated that you observed the flows
con7ing from a "mud Jine" in the rib. Provide a detailed description of the pflysical
locations and nah;re of the flow. Specify t-vhether the flours occ.;;rred from the
north, sGUth, easf, or tivest rib, andor fiam the roof or floor. Please describe ho~v
the flows vrere t•:rst obsen^ed, and trGw flow estimates were obtained.
Bear -Water was first encountered in the Bear No. 3 Mine in the B-Seam at
approximately crosscut 24 in the 3rd west section. The water emerged from the
north facing rib and floor in mid 1994. The water seep was isolated to the lower
half of the rib and floor. The "mud line" located 30 to 36-inches below the roof,
defined the upper extent of the seep. Bear did not estimate the flow rate for this
seep.
3. D7LfG -Ara yotr certain that tl7e area of inflow at the 3"' west sectiGr7 4vas r7ot
flowing any +^~ater or producing any rnoisture for a sigr7ificant period of time
beginning in f 933 s^rhen the area ~a~as first reined. If so, please describe hour you
can be certair7 that the area was initially dry. Now much tirne passed from initial
3''' west sectior7 developn7er7t, to the tin7e of your ir7itial observation of water f1o;a~
tron7 the mine section?
Bear -The area of inflow at the 3`d west section was initially mined in June of
1993. Dan Bear was in the mine daily during this time and inspected the active
mine workings. Mr. Bear has confirmed that this area was dry when it was mined
in June of 1993. Approximately one year later, in mid 1994, water was noted in
the return at approximately crosscut 24 in the 3`d west section.
4. D>L9G - Frior to the inflovrs now docurr7er7ted ir7 the 3"' west section, did ar7y Bear
Coat Cornpar;y personr;el observe any rnine inflows, puddle areas or arry other
signs of inflow or rnoisture ar7ywhere ir7 tt7e B or C seam mine areas of the Bear
No. 3 tvfir7e? !f so: please describe t17e areas and observations. Did a.ny areas of
tl7e Bear No. 3 Mine accurn;r/ate any water prior to the, observed flG:vs in the 3"'
West Section? /f so, describe the 1GCatior7 and arrrounts Gf any water
accumulations.
Bear -Prior to the inflows in the 3`d west section, Bear did encounter drips in the
roof at the end of the 3`d west mains. Bear estimates these drips produced a
