Phase 1 MINING PLAN REQUIREMENTS (CHANGES FROM ORIGINAL PLAN) -
Requirement: Phase 1 will remain basically as originally designed with respect to the area of
mining and the direction of mining. However, the slurry wall installation at the end of Phase 1
has been deleted from this plan. (No discussion associated with this requirement)
Requirement: Phase 1 will be backfilled using a series of sediment basins. Wash fines in
combination with overburden and soil shall be used to backfill Phase 1. (See Page 21)
Requirement: The actual arrangement of sediment basins may vary a[ [he discretion of the
operator so long as all basins have at least one side with an unsealed connection to adjacent
unmined land and a significant portion of the groundwater is allowed to flow completely
through the backfilled area. (No discussion associated with this requirement)
Phase 2 MINING REQUIREMENTS -
STEP 1: Streambank Strengthening and Protection Issues
Requirement: Prior [o mining Phase 2, s[reambank strengthening and stabilization shall be
installed along the river bank south of Phase 2 at all locations where it is expected that
erosion may occur. The preference will be for the installation of closely spaced (20 feet or
so) jetties keyed into the bank and extending a short ways into the river flow. Prior to
installation approval from the U.S. Army Corps of Engineers may be required.
(See Page 22)
Requirement: As an additional precaution, the southern side of the pit will not be mined
within 300 feet of the river until any s[reambank stabilization on the river bank has
developed to a paint where it can protect the bank from undercutting. For [he first two or
three years of the operation in Phase 2, mining will stay north of that 300 foot setback. (No
discussion associated with this requirement)
Requirement: A temporary overflow protection berm will be constructed along the south
edge of the affected land. This berm may require FEMA approval prior [o construction.
(See Page 29)
Pueblo East Pit Amendment 3 (2007) Exhibit D Page 4 of 34
