6. On October 1, 1986, the permittee was issued Notices of Violation Nos. C-86-068 <br />and C-86-069 for failure to maintain sediment pond 15-P20 and for failure to repair <br />gullies. <br />7. On November 4, 1986, the permittee was issued Notice of Violation No. C-86-073 for <br />failure to follow the mine site hydrology monitoring plan. <br />8. On July 26, 1991, the permittee was issued Notice of Violation No. C-91-009 for <br />failure to properly treat disturbed area runoff. <br />9. On July 16, 1992, the permittee was issued Notices of Violation Nos. C-92-013 and <br />C-92-013 for failure to maintain sediment pond 15-P1 and for failure to treat <br />disturbed area drainage. <br />10. On August 14, 1992, the permittee was issued Notices of Violation Nos. C-92-020 <br />and C-92-021 for failure to maintain sediment pond 15-P11 and for failure to maintain <br />permanent impoundments 15-P1, 15-P2, 15-P20, and 22-P17. <br />1 1 . On August 28, 1992, the permittee was issued Notice of Violation No. C-92-027 for <br />failure to maintain roads. <br />12. On October 6, 1992, the permittee was issued Notices of Violation Nos. C-92-028 <br />and C-92-029 for failure to maintain permanent impoundment 15-P2 and for failure to <br />maintain sediment pond 15-P11. <br />13. On February 22, 1993, the Administrator of the Division of Minerals and Geology <br />determined that a Pattern of Violations as defined in 5.03.3(2) existed at the Trinidad <br />Basin Mine, as a result of the permittee receiving Notices of Violation Nos. C-92-013, <br />C-92-014, C-92-020, C-92-021, C-92-028 and C-29-029. <br />14. On April 22, 1993, the Division held a formal public hearing pursuant to an Order <br />issues by the Division on February 22, 1993 to Trinidad Basin Mining Company to <br />Show Cause Why its Permit Should Not Be Revoked, and subsequently revoked <br />Permit No. C-81-048. <br />CONCLUSIONS OF LAW <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board <br />by C.R.S. 124(4) and Rule 3.04.1(1), and based upon the aforementioned Findings of <br />Fact, the Board hereby concludes the following: <br />1 . The permittee has failed to conduct the surface mining and reclamation operations in <br />accordance with the Act, these Rules and the permit within the time required. <br />2. The permittee has failed to comply with the reclamation schedule as outlined in the <br />November 14, 1984 Board Order. As such, establishing a new schedule per Rule <br />3.04.1(2) would be inappropriate. <br />3. It is necessary, in order to fulfill the requirements of the permit and the reclamation <br />plan, to have someone other than the permittee complete reclamation. <br />
