<br />BOARD ORDER <br />Pursuant to the authority vested in the State of Colorado Mined land Reclamation Board by <br />C.R.S. 34-33-12414) and Rules 3.04.1, 3.04.2 and 3.04.3, the Board hereby orders the <br />following: <br />The performance bonds submitted by Trinidad Basin Mining Company for the Trinidad <br />Basin Mine in the amount of $132,280.00 shall be forfeited in their entirety, to be <br />used for the purposes of completing reclamation of disturbances associated with <br />Revoked Permit No. C-81-048. <br />2. The Division shall, pursuant to Rule 3.04.2(51, notify the First National Bank of <br />Trinidad of its option to demonstrate to the Division its ability to complete the <br />reclamation plan, as an alternative to the Division proceeding with collection of the <br />forfeited bond amount pursuant to Rule 3.04.2111(cl. <br />3. If the amount of the bonds is insufficient to pay for the full cost of reclamation, then <br />pursuant to Rule 3.04.2(61, the permittee shall be liable for the balance. The Division <br />may complete necessary reclamation to the extent the forfeited funds permit, and <br />recover from the permittee, by means of civil proceedings and remedies, all <br />reclamation costs in excess of the forfeited amount to complete the remaining <br />reclamation. <br />In clarification of the rights of recipients of Board Orders for Bond Forfeiture, parties are <br />advised to consult the Colorado Surface Coal Mining Reclamation Act and the State <br />Administrative Procedures Act. <br />Persons concerned with the judicial review of the provisions of this Findings Document are <br />advised to consult C.R.S. 24-4-106 as amended. <br />Dated at Denver this ~ day of ~, 1993. <br />Mined Land Reclamation Board <br />Colorado Department of Natural Resources <br />l /!~ 2 ~~ <br />M xine Stewa irman <br />Mined Land Reclamation Board <br />M:\OSS\SCG\7547 F.wpf <br />5/24/93 <br />
