<br />BOARD ORDER <br />Pursuant to the authority vested in the State of Colorado Mined land Reclamation Board by <br />C.R.S. 34-33-12414) and Rules 3.04.1, 3.04.2 and 3.04.3, the Board hereby orders the <br />following: <br />The performance bonds submitted by Trinidad Basin Mining Company for the Trinidad <br />Basin Mine in the amount of $132,280.00 shall be forfeited in their entirety, to be <br />used for the purposes of completing reclamation of disturbances associated with <br />Revoked Permit No. C-81-048. <br />2. The Division shall, pursuant to Rule 3.04.2(51, notify the First National Bank of <br />Trinidad of its option to demonstrate to the Division its ability to complete the <br />reclamation plan, as an alternative to the Division proceeding with collection of the <br />forfeited bond amount pursuant to Rule 3.04.2111(cl. <br />3. If the amount of the bonds is insufficient to pay for the full cost of reclamation, then <br />pursuant to Rule 3.04.2(61, the permittee shall be liable for the balance.
