STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />In the matter of: Trinidad Basin Mining Company Bond Forfeiture <br />Trinidad Basin Mine <br />Permit No. C-81-048 <br />To: Trinidad Basin Mining Company and all other persons engaged in or owning or <br />controlling the following operation: Trinidad Basin Mine, Las Animas County, <br />Colorado. <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board <br />by C.R.S. 34-33-124(4) and Rule 3.04 of the Regulations of the Colorado Mined Land <br />Reclamation Board for Coal Mining, the Board convened a formal public hearing regarding <br />forfeiture of the performance bonds totalling 5132,280.00 posted by Trinidad Basin Mining <br />Company for the Trinidad Basin Mine. This formal public hearing was held on April 22, <br />1993. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board <br />by C.R.S. 34-33-124(4) and Rule 3.04.1, the Board hereby makes the following findings <br />of fact: <br />On November 14, 1984, the Board held a formal public hearing to consider an Order <br />issued to the permittee from the Division of Minerals and Geology to Show Cause <br />Why its Permit Should Not Be Revoked. The Order had resulted from a Pattern of <br />Violations being determined to exist from Notice of Violation Nos. C-83-31, C-83-32, <br />C-84-027, C-84-071, C-84-072, and Cessation Orders Nos. CO-84-138 and <br />CO-84-146. As a result of the issues raised in the Hearing, the Board suspended the <br />permit and ordered reclamation of the site by July 31, 1985. <br />2. On February 5, 1985, the permittee was issued Notices of Violation Nos. C-85-005 <br />and C-85-006 for failure to construct a sediment control system and for failure to <br />repair rills and gullies. <br />3. On August 6, 1985, the permittee was issued Notices of Violation Nos. C-85-072 and <br />C-85-073 for failure to complete reclamation in accordance with the Board Order of <br />November 14, 1984 and for failure to complete reclamation of the mine loadouts. <br />4. On November 25, 1985, the permittee was issued Cessation Order No. CO-85-84 for <br />failure to abate Notice of Violation No. C-85-073. Also on November 25, 1985, the <br />Board held a formal public hearing and accepted voluntary reclamation by the operator <br />of 552,950.00 as payment for civil penalties totalling S24,760.00. <br />5. On June 11, 1986, the permittee was issued Notices of Violation Nos. C-86-048 and <br />C-86-049, for failure to maintain ID signs and for failure to maintain ponds 15-P1 and <br />15-P10, and Cessation Order CO-86-50 for failure to prevent tension cracking and <br />erosion in a backfilled area. <br />
