._ ->_.. <br />E~~A <br />S Coal Company Seneca Coal Company <br />April 24, 1998 RECEIVE[? <br />Mr. Michael Long <br />Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203-2273 <br />liE: Yoast Mine, Permit C-94-082, NOV No <br />Dear Mr. Long: <br />APR 2 7 1998 <br />Division of Minerals b Geology <br />CV-98-002 <br />In response to the NOV No. CV-98-002 for the Yoast Mine, Seneca <br />Coal Company respectfully submits the following information with <br />regard to the violation. we believe that based on several <br />previous phone conversations with your staff and the April 7t h <br />inspection at the mine that this NOV should be vacated. <br />The NOV was issued on March 5th for (a) failure to construct the <br />haul road within the standards of vertical alignment, which state <br />that the maximum pitch grade should not be steeper than 158, and <br />that there should not be more than 300 feet of pitch grade <br />exceeding 108 within any consecutive 1000 feet and in no case <br />should the grade be steeper than 158, and (b) failure to <br />construct haul road in accordance with approved plan and with <br />horizontal alignment as consistent with existing topography as <br />possible and providing the alignment required to meet the <br />performance standards of 4.03.1. The violation applied to the <br />southernmost portion of Haul Road B between stations 56+00 and <br />62+00 and was issued following the submittal of Technical <br />Revision 09, the as-built reports and drawings for Haul Roads A <br />and B. <br />Seneca received the NOV on March 9th and immediately telephoned <br />Mr. Larry Routten and Mr. Jim Burnell to discuss the violation in <br />detail. They were told to review correspondence which I submitted <br />to the Division regarding the Haul Road A and B as-built <br />certifications on the following dates: November 22, 1996, March <br />11, 1997 and November 4, 1997. Seneca submitted Minor Revision 08 <br />to the Division, which was subsequently approved on August 26, <br />1996. A portion of this revision modified the original design for <br />Haul Road B. The final 0.5 miles of original haul road was <br />removed and the ending point for the haul road was relocated <br />closer to the coal recovery area. The horizontal alignment of the <br />final 600 feet of Haul Road B was also shifted from the original <br />designed location. This approved revision addresses part (b) of <br />the violation since the Division was aware of the modified <br />portions of Haul Road B, which were identified in the violation. <br />Seneca Coal Company • P.O.
