_ -« <br />Mr. Michael Long <br />Page 2 <br />April 24, 1998 <br />As for part (a) of the violation, Seneca did make an error in the <br />as-built report and drawings for Haul Road B when the Technical <br />Revision 09 package was submitted for approval to the Division. <br />The ending point for Haul Road B was taken to the edge of the <br />coal recovery line. This was done to stay consistent with the <br />other similar haul road as-built reports which the Division had <br />approved previously for the Seneca II-W mine. What I failed to <br />remember was that the last 600 feet of Haul Road B was spoiled on <br />by the initial boxcut for coal stripping operations in this area. <br />In addition to this, we also needed to construct the pit ramp in <br />this area to get in and out of the pit itself. The last 600 feet <br />stretch of the designed Haul Road B, which the NOV applies to, is <br />constantly being worked on by our road maintenance equipment; <br />therefore, both the horizontal and vertical alignment is changing <br />quite frequently. <br />We also had a meeting earlier this year with both Larry and Jim, <br />to discuss the road system that will be developed in the future <br />at Yoast. Our main road to the south reserve area will branch off <br />the existing Haul Road B in the vicinity of station 56+00. In <br />discussions at the mine on April 7th during their inspection, we <br />all came to the conclusion that the end of Haul Road B should be <br />at station 56+00. This point reflects where Haul Road B ends and <br />turns into a pit ramp. With that in my mind, the vertical <br />alignment for the existing Haul Road B is within the design <br />criteria and also meets the performance standards and other <br />regulations applicable for haul roads. <br />Based on the information provided, Seneca believes that the NOV <br />should be vacated. I believe discussions with both Larry and Jim, <br />would clarify any of the information contained in this <br />correspondence or answer any questions you may have regarding the <br />NOV. I apologize for any inconvenience my failure to submit the <br />correct as-built information initially in TR-09 has caused your <br />staff and appreciate their efforts in working with us on this <br />revision.
