<br />the hard copy of this document. 1) Industrial Land Use (Canon City Designation) in~:ludes that <br />2.3 acre parcel containing the haul road from shop facility to Tunnel Drive. This parcel was <br />approved by City Council for Industrial Use Designation in 1995, will continue as such for the <br />life of mine, and will continue after minitf~ Industrial Use Designation by Fremont County is in <br />affect for 10 acres of affected land comprising the SE1/4NEl/4 Section 31 including the pit and <br />highwall area of the existing mine area which is part of a 140 acre Industial Use Designation that <br />Fremont County deemed Industrial/Mining Land Use atleast 25 years ago. It is the intent of the <br />mine operator to continue said land use during and after mining of the area. The AfFected Land <br />within the Northeast quarter of Section 31 is designated Agricultural Farming and Ranching <br />Zone District by Fremont County and includes the final land use of open rangeland/vnldlife <br />habitat as submitted with the original permit application. It is the intent of the mine ~~perator to <br />continue this land use after mining, with the exception of the highwall areas which v.•ill be <br />excluded from rangeland wildlife habitat via fencing. Those areas within the affecte~j land <br />boundaries in the Southwest quarter of Section 31 (35 acres) are currently designated <br />Agricultural Forestry District by Fremont County. It is the intent of the mine operator to <br />continue this land use in this area after mining. Finally, the area of the affected land lying within <br />the Southeast quarter of Section 31, namely the proposed haul road access area totaling 5 acres, <br />is zoned R-2 Residential by the City of Canon City. It is the intent of the mine operator to <br />continue this land use during and after mining operations. In short, Tezak Heavy Egriipment <br />Company, Inc., chooses to operate its mining operations in accordance with all City and County <br />Land Use designations as currently in affect now and after completion of mining operations on <br />all affected lands. Should this declaration of intent for final land use change the schedule of <br />public and agency time necessary for review and approval of this mining permit amendment <br />application, please inform T.H.E. and its agent of the necessary process to proceed. <br />This declaration is in accordance with existing local land use designations in affect a~. this time <br />and is intended to meet all current and future city and county land use criteria. <br />Paragraph 8 item 3)-- the upper half of the existing haul road will not exist at the end of the life <br />of mine, in that it will be mined out during extraction of the lower reaches of the mineable <br />reserve included in the fifty year reserve estimates. Therefore, the area that now exists as the <br />upper part of the existing haul road will be a lower elevation portion of the pit area in the <br />Northeast quarter and Southeast quarter of Section 31 and is included within the cost estimates <br />of reclamation as stated on page 22 of the permit application package. An estimation of haul <br />road removal costs would be doubling reclamation the reclamation cost per se for this; particular <br />area already covered by reclamation cost estimates. <br />11. State of CoYorado Division of Water Control Division, Department of Health <br />coorespondence-- the mine operator has requested and met at the site with Division of Health <br />personnel in early January, 1997, regarding a review of the stormwater management plan as <br />proposed and discharge permitting requirements. The Division of Water Quality has promised <br />to respond in writing as soon as possible. Written coorespondence has not been recieved'as yet, <br />although verbal comments to the writer by WQCD personnel have confirmed that a g~:neral <br />4 <br />
