The drainage pattern for the lower half of the proposed roadway will be essenti~clly the <br />same as presenetly exists-- stormwater will drain along both sides of the roadway via the <br />"catchpoint" ditches until they intersect tl~,pavement of Tunnel Drive, at which point storm <br />flows will cross Tunnel Drive pavement an$~'$ow into the the Sand Gulch drainage channel <br />developed along the Southern aspect of Tunnel Drive. Stormflows will enter Sand Gulch <br />drainage just downstream from the Tunnel Drive crossing and will thence drain into ~:he <br />Arkansas River approximately 1000 feet South of the intersection of Tunnel Drive ar~d Sand <br />Gulch drainage. It should be noted that no measureable change in present storm drainage <br />volume or peak discharge is anticipated at the lower half of the proposed haul road from the <br />present conditions and no structures or property impacts are expected. The total watc;rshed area <br />influencing the lower half of the proposed access route is less than three acres and is will not <br />change in any respect to stormflow modeling other than the fact that the roadway will be paved. <br />The lower half of the proposed roadway will be used not only by Tezak Heavy Equipment but <br />also by City of Canon City personnel for access to the water treatment plant. It is in i.he best <br />interest of Tezak Heavy Equipment Company, Inc., to use and maintain the access road <br />including drainage considerations in accordance with best management practices subject to the <br />review and approval of the City of Canon City engineering and management. This aspect to <br />operational management will be included in the language of the contract addressing design, <br />construction, operation, monitoring, and modification if necessary to comply with Ci ry of Canon <br />City in all aspects of the road access now and in the future. <br />8. Tezak Heavy Equipment Company, Inc., is committing to a construction and maintenance <br />program that will cost T.H.E. in the range of one million dollars in upfront costs and large <br />amounts of road maintenance and environmental control maintenance to assure a safe and <br />reasonable access of T.H.E. and customer trucks to the mine site with a minimum impact to <br />Tunnel Drive residents. Critical to this commitment is the formal legal agreement between <br />T.H.E. and the City of Canon City in regards to a long term road easement agreement. The <br />language of the legal document will address the issue of exemption of reclamation of the road <br />right-of--way as long as road maintenance and use are continued to the satisfaction of the City of <br />Canon City. Should the City of Canon City at any time determine that the roadway i~ not <br />operated or maintained in accordance with best managment practices as determined ley the City, <br />reclamation of the right-of--way must be instrumented by Tezak Heavy Equipment Company. <br />The detail and extent of reclamation will be determined by the City of Canon City. II is intended <br />by the writer of this document to satisfiy item 1, paragraph 8. of DMG 2nd Adequancy Review <br />page 2. with via copy of final road access document when as soon as it is available. <br />Item 2) of paragraph 8 shall be addressed as follows: In light of review of all current oning <br />designations now in affect for various portions of the affected lands as described in this permit <br />application, Tezak Heavy Equipment Company, Inc., desires to continue all zoned land uses as is <br />currently designated via the map of zoning designation for property within the city limits of <br />Canon City and the County of Fremont, State of Colorado. Specifically, there are four different <br />zoning classifications cooresponding to approved land use within the affected land boundaries of <br />mining permit M-77-193.
