Section 2.03.5, Compliance Information 2. Please update Section 2.03.5, Compliance Information, if applicable. The Division has no further concerns. Revised pages 18, 18a, and 18b were presented in the submittal dated January 23, 2003. Section 2.03.10, Identification of Other Licenses and Permits 3. If applicable, please update the ]ist of other licenses and permits in Section 2.03.10. The Division has no further concerns. The operator stated that no permit updates were required. Section 2.05.3, Operation Plan -Permit Area 4. Please update BRL 's intentions concerning the disposal of the run-of--mine (ROM) pile material. Does BRL still consider disposal of the ROM material on the east mine portal bench (TR-39) a viable option or can TR-39 be withdrawn? In the submittal dated March 28, 2003, BRL revised page 31 of Section 2.05 to state that BRL will submit a technical revision that will deal with the disposal of the ROM material at the various East Mine benches upon reclamation. In addition, as requested in a letter from BRL dated March 28, 2003, Technical Revision No. 39 was withdrawn. That revision involved the disposal of the ROM material on the portal bench at the East Mine. The Division has three additional questions concerning the March 28, 2003 submittal. a. In the fifth paragraph from the top on revised page 31 of Section 2.05, it is stated that there are 6,000 tons ofROMmaterial left in the stockpile. However, in the next sentence, it is stated that this remaining 17,000 tons ofROMmaterial will be backfilled at the reclaimed East Mine. Please reconcile the difference in amounts. The Division has no further concerns. The typographical error of 6,000 tons was corrected in the submittal dated May 15, 2003 to read 17,000 tons on revised page 31 of Section 2.05. b. Should the amount of ROMstated on revised page 31 and 606 of Section 2.05 be in tons or cubic yards? The Division has no further concerns. Pages 31 and 606 of Section 2.05 were revised in the submittal dated May 15, 2003 to state that the units are in cubic yards. c. Does the stated amount of ROM that remains include the cooly material that is currently stored on the east end of the warehouse/shop bench?
