BRL's responses to the DMG's comments and concerns follow. DMG -Rule 2.07.6(2)(d)(iv)(D) requires that the applicant secures all of the necessary approvals for any affected area that is proposed to lie within 100 feet of the outside right- of-way of a public road. Because a portion of the proposed coal stockpile and truck loadout are within 100 feet of Old Highway 133, BRL will need to submit to the Division written approval from the Colorado Department of Transportation for the location of these facilities within the right-ot=way. BRL -Enclosed is a letter dated January l2, 1999 from the Department of Transportation which states it is permissible for the proposed permit boundary and the proposed mining activities to be conducted within 100 feet of the nearest right-of--way line of old State Highway 133. The letter should be inserted into Volume III, Tab 14 Letters.
