BRL's responses to the DMG's comments and concerns follow. <br />DMG -Rule 2.07.6(2)(d)(iv)(D) requires that the applicant secures all of the necessary <br />approvals for any affected area that is proposed to lie within 100 feet of the outside right- <br />of-way of a public road. Because a portion of the proposed coal stockpile and truck <br />loadout are within 100 feet of Old Highway 133, BRL will need to submit to the Division <br />written approval from the Colorado Department of Transportation for the location of <br />these facilities within the right-ot=way. <br />BRL -Enclosed is a letter dated January l2, 1999 from the Department of Transportation <br />which states it is permissible for the proposed permit boundary and the proposed mining <br />activities to be conducted within 100 feet of the nearest right-of--way line of old State <br />Highway 133. The letter should be inserted into Volume III, Tab 14 Letters. <br />
