In compliance. The Division has approved additional time (over 60 days) for backfilling of the <br />pits to accommodate tyash disposal operations (PAP, page 1 17). The life of disposal operations <br />is estimated to 2010. <br />Rule 4.14.2 General Grading Requirements <br />The areas of disturbance have, or will be, graded to approximate original contours, and will blend <br />in with the surrounding areas (PAP, page 1 13). <br />Rule 4.14.3 Covering Coal and Acid- and Toxic-forming Materials <br />Incompliance. The un-excavated coal in the seam, flyash and hard-rock mine waste is covered <br />by 6 feet of spoil and two feet of topsand (PAP, page 114). <br />Rule 4.14.4 Thin Overburden <br />In compliance by exception. The disposal of flyash brings closing final grades to near <br />approximate original contours. <br />Rule 4.14.5 Thick Overburden <br />Incompliance by exception. Based on current estimates, available spoil will be used to cover the <br />flyash. (PAP, page 114). <br />Rule 4.14.6 Regrading or Stabilizing Rills and Gullies <br />Incompliance by exception. No rills and gullies have developed at [he site. <br />Rule 4.15 Revegetation <br />Rule 4.15.1 General Requirements <br />In compliance. The plan calls for a diverse, effective and permanent vegetation cover. Prompt <br />establishment of cover and recovery of productivity levels are objectives. The vegetation cover <br />is, or will be, capable of stabilizing the soil surface. Fencing is used to maintain proper <br />management practices. Monitoring is conducted. (PAP, pages 115 and l 16). <br />Rule 4.15.2 Use of Species <br />Incompliance. The approved revegetation plan emphasizes native species planting resulting in a <br />diverse, permanent, effective plant community capable ofself-regeneration.
