Rule 4.05.7 Discharge Structures <br />In compliance by exception. The spillway is concrete lined with a concrete outlet. No additional <br />features are required. <br />Rule 4.05.8 Acid-forming and Toxic-forming Spoil <br />No acid forming or toxic forming spoil is known to be on site (Permit, page 1 13). Disposal of <br />hard rock mine wastes has been permitted in Pit 2. This material is sandwiched in between <br />flyash, the pit clay bottom, and spoil and topsand cover (Permit, pages 113 through 1 146). <br />Rule 4.05.9 Impoundments <br />In compliance. Sedimentation Pond 2 and the incised pond have been authorized as permanent <br />impoundments. <br />Rule 4.05.10 Underground Mine Entry and Access Discharges <br />In compliance by exception. There are no such discharges at the site. <br />Rule 4.05.1 1 Ground Water Protection <br />Incompliance. Hard rock mine wastes are sandwiched in between flyash. Flyash is sandwiched <br />in between a floor clay liner and spoil cover (Permit, pages 113 through114b). Drill holes have, <br />or will be, sealed (Permit, page 1146). <br />Rule 4.05.12 Protection of Ground Water Recharge Capacity <br />[n compliance. Flyash in Pit A, and upon completion, flyash in Pit B, will be encapsulated in <br />clay and spoil materials to isolate flyash and mine waste rock from the underground water <br />system. Recharge would be around the envelopes and into the surrounding materials. <br />Rule 4.05.13 Surface and Ground Water Monitoring <br />4.05.130) Ground Water <br />In compliance. The ground water monitoring program is described on page 56 through 576 of <br />the Permit. <br />4.05.13(2) Surface Water <br />In compliance by exception. There is no surface water monitoring program at the site. The <br />NPDES requirement for monitoring of Sediment Pond 2 discharges has expired. <br />20 7 September 1999 <br />
