Rule 4.03 Roads <br />In compliance. All roads have been classified as access roads as there is no coal production at <br />the site. Road certifications are on file. <br />Rule 4.04 Support Facilities <br />Incompliance. Facilities have been designed, constructed, and maintained, and proposed <br />reclamation activities have been designed, to minimize adverse environmental impacts. <br />Rule 4.05 Hydrologic Balance <br />Rule 4.05.1 General Requirements <br />Incompliance. <br />Rule 4.05.? Water Quality Standards and Effluent Limitations <br />Incompliance by exception. The NPDES permit associated with mining activities has been <br />allowed to expire. <br />Rule 4.0.3 Diversions <br />Incompliance. There aze no diversions of natural flows at the site. Runoff from disturbed aeeas <br />is diverted to Sedimentation Pond 2. <br />Rule 4.05.4 Stream Diversions <br />In compliance by exception. There aze no stream diversions at the site. <br />Rule 4.05.5 Sediment Control Measures <br />Incompliance. Perimeter ditches direct surface flows to a sedimentation pond. Disturbed areas <br />aze seeded at the first window after final grading. Temporary stockpiles are protected from <br />erosion by vegetation. <br />Rule 4.05.6 Sedimentation Ponds <br />In compliance. One sediment pond, Sediment Pond 2, is still onsite. Another pond (the Dugout <br />Pond), an incised pond is also on site locatedjust upstream on a south drainage to Sediment Pond <br />2. Sediment Pond 2 is designed to contain the runoff from a l0-year, 24-hour storm. It has a <br />combined spillway. It is a combination incised and low berm facility. The ponds are inspected <br />on a quarterly basis (Permit, pages 108 and 109). <br />19 7 September 1999 <br />
