Malouff/M-82-033
5/27/97
page 4
Also, if the revised area to be affected is on both the northeast and southwest sides of the irrigation
ditch, please mention that structure here (size, location, name or owner, etc./ even if you do not plan
to affect land within 200 feet of either side of it.
Exhibit J -Vegetation Information
Your submittal is not complete. You must provide more detailed information about the plant species
present on the undisturbed part of the permit area. This information may be obtained from the soil
conservation office.
Exhibit K -Climate Information
Your submittal is not technically adequate, though Lavern may consider it complete. Please provide
a summary of the annual temperatures and precipitation, plus wind if possible. You may be able to
obtain this from the soil conservation office or chamber of commerce.
Exhibit L -Reclamation Costs
This exhibit is complete, but not technically adequate. The costs included in this summary must
match the tasks and schedules described in Exhibits D, E and F. If pit slopes are not maintained at
3:1 during mining, you must account for the grading work. If you plan to replace topsoil and seed
the area, your summary here must include that task and its cost. Even if the tasks and costs are not
to be changed from the present cost estimate, you must include a better description of the work to
be done, e.g., volumes of material to be moved by what specific piece of equipment over what
distances and gradients and surfaces. Please include equipment mobilization costs from Alamosa.
Exhibit M -Permits and Licenses
Your present operation involves crushing, and presumably future operations will also. Please state
whether you now hold or will inquire about a Colorado Department of Health air emissions permit for
fugitive dust. Your county may require a permit too. Please comment. If you ever plan to batch
asphalt here, be advised that the State may require a permit for that.
Exhibit O -Owners of Affected Land and Substance to be Mined
You have stated that you are the owner of the land and subsurface minerals, and that is all the Rules
require that you provide. Please consider that this exhibit is complete for Lavern and technically
adequate for me.
Be advised, however, that if you plan to disturb land within 200 feet of any structure owner by
another party, you must provide proof of adequate notices, damage agreements, etc. If any above
ground or underground utilities or surface water conveyances li.e., ditch) are in the permit area or
within 200 feet, please describe any easements that may be attached to these.
Exhibit O -Proof of Mailing Notices to Commissioners and Soil Conservation District
The proof of delivering these items, provided with the first submittal in March, was adequate for that
first filing with the Division. As Lavern states in her letter of April 30, every change to your
application via additional submittals to this office must be sent to those offices also, and proof of that
sent to the Division.
Exhibit R -Proof of Filing Application with the Countv Clerk and Recorder
As described under Exhibit O above, additional filings reflecting changes to your application,
