You may <br />either explain that there are no structures owned by other parties within 200 feet of any part of your <br />new permit boundary, or that even if there are such structures, you will not affect any land within <br />200 feet of them. If you plan to affect any land within 200 feet from any permanent structure, <br />please provide the required documentation described in Rule 6.4.19. <br />Affidavit of Postino Notice <br />As provided in Rule 1.6.2(1)(bl, ypu must provide an affidavit stating that you posted a Notice <br />informing the public of a permit filing with the Division. During mypre-operation inspection, I did not <br />see the Notice, though you had in fact submitted the signed affidavit. In our subsequent phone <br />conversation, you said that the Notice was on the office trailer down in the far part of the pit. Since <br />this is obviously out of view of the public, and the Rule specifies that it be posted at the site's access <br />location, you should post it again in the proper location, fill out the affidavit again and resubmit it. <br />Please ensure that you examine and correct the dates. <br />This is the extent of my review at this time. At the very least these items listed should be prepared <br />or corrected, and submitted. If the application is to be revised substantially, please use the letters <br />written to you already as guides for what is expected in future submittals. Remember, the original <br />1 10 application did not require as extensive documentation as this 1 12 does, plus you are applying <br />far a permit on a much larger area. Please ensure that all the pieces of the application fit, and do not <br />use those pieces from the original that do not fit. Before submitting any new application materials, <br />please review the applicable portion of Rule 6.4 for completeness and correctness. <br />Until Lavern receives all items necessary to call the application "complete" the 90-day review period <br />will not begin. After it begins, I will be better able to devote time to working out the "technical" <br />problems with you. Be reminded that you must get this conversion completed soon, since you are <br />rapidly nearing the limit of your permitted 8.3-acre area. As you know, offsite damage is a possible <br />violation.
