<br />Walker to File <br />February 1, 2000 <br />Page 12 of 16 <br />Retention of the trail/light-use (pre-existing) road previously used for access to the airshaft, with <br />vehicle access restricted, at the request of the landowners (see page 4-98d of the PAP) is consistent <br />with the approved (continuing) land use of rangeland (seeded, and provides access for livestock) and <br />open Federal land. There are no applicable performance standards for trails. No certifications were <br />found on file for this pre-existing fan shaft road as meeting performance standards of access roads. <br />By this technical revision, retention of the two-track trail across the pastureland between County <br />Road 109 and the Roaring Fork River is approved as part of the approved (continuing) postmining <br />land use of pastureland [a facility in support of pastureland, see Rule 1.04(71)(b)](see page 4-iv of <br />the PAP). <br />Rule 4.05.2 Water Quality Standards and Effluent Limitations <br />The requirements of Rule 4.05.2 are engaged by reference in Rule 4.09.1(1)(6). <br />Rule 4.05.2(1) Sedimentation Pond or Water Treatment <br />Surface water above the treatment facility will, after flowing through grass areas, will flow into the <br />treatment pond <br />Rule 4.05.2(7) Discharges <br />The application is in compliance with this rule. Discharges from the treatment facility and the <br />sedimentation ponds are controlled by a discharge permit, under the jurisdiction of the Colorado <br />Department of Public Health and Environment. <br />Rule 4.06.1(1} Salvage of Topsoil <br />As submitted, the application did not describe the removal of topsoil from the pond cleaning disposal <br />site. The deficiency was brought to the attention of the applicant in an adequacy letter of October <br />27, 1999. A response of November 22, 1999, with a revised page 4-66j, was found adequate. <br />Rule 4.06.1(2) Redistribution of Topsoil <br />The application is in compliance with this rule.
