The original application did not address <br />the removal of vegetation. By an adequacy letter of October 27, 1999, the applicant was asked to <br />address this topic. A response of November 22, 1999, with a revised page 4-66j, was found adequate. <br />Rule 4.06.2(2)(a) Material <br />The application is in compliance with this rule. No vaziances are requested. <br />Rule 4.11.4 Disposal of Noncoal Waste <br />Rule 4.11.4(1) Placement and Storage <br />The application is in compliance with this rule. Water treatment system cleanings are noncoal <br />wastes. They are to placed and stored immediately adjacent to, and upgrade, from the long pond. <br />Rule 4.11.4(2) Final Disposal <br />The application is in compliance with this rule. Final disposal is in a designated disposal site in <br />the permit azea (see DrawingD-2-5). Leachate will migrate directly back into the water treatment <br />system or will mingle with seepage from the treatment long pond. Surface runoff above the <br />treatment pond will flow through grass areas and into the treatment pond. Soil cover prevents <br />fire. The excavated pit of the site will remain stable and the covered surface will be suitable for <br />reclamation compatible with the natural surroundings. Wastes aze to be routinely compacted and <br />covered to prevent combustion and wind-bom waste. When each segment of the disposal is <br />filled, a minimum of 2 feet of soil cover shall be placed over the site, slopes stabilized, and <br />revegetation accomplished in accordance with Rule 4.15. Operations of the disposal site shall be <br />conducted in accordance with the local, State and Federal requirements. In an adequacy letter of <br />October 26, 1999, the applicant was asked to include any permit required for this activity in the <br />list of permits under Rule 2.03.10. None was required (Pitkin County letter of November 29, <br />1999). <br />Rule 4.15 Revegetation <br />The application is incompliance with this rule. Reclaimed azeas (the waste disposal site for water <br />treatment system cleanings) of disturbance are subject to the provisions (unchanged by the <br />technical revision} of the existing PAP. <br />Future Actions <br />Any responses from agencies or the general public on the proposed decision will be forwazded to <br />the Applicant.
