Walker to File <br />February 1, 2000 <br />Page 11 of 16 <br />approved postmining land use; thus the road need not be reclaimed. <br />Rule 4.03.2 Access Roads <br />By this technical revision, the former access roads to the fan shaft and the corridor for the coal <br />loadout conveyor are reclassified as light-use roads/trails. <br />Rule 4.03.3 Light-Use Roads <br />Rule 4.03.3(3) Design and Construction <br />The road to the fan shaft is apre-existing road. The road appears as a trail on the Stony Ridge <br />USGS 7.5 Minute Series topographic map. The date of source photography is ] 962. The road <br />appears on a photograph dated 7/12/74. Thus the road is exempt from the vertical alignment <br />specifications of Rule 4.03.3(3)(a). (Field measurements found the overall grade of the road up <br />the north side to be approximately 12%, with short pitches up to 20%, and overall grades down <br />the south side of approximately 1 l% with short pitches up to 15%.) The road is incompliance <br />(culvert have been in place over 1 Oyears, capacities were not calculated} with all other <br />specifications (unobserved construction, as-built evaluations, Division inspections). <br />There are no applicable performance standazds for the remnant two-track trail of conveyor belt <br />construction, maintenance, and demolition. No indication that there was an access road was <br />found in the PAP. No certifications were found on file for the two-track road as meeting <br />performance standazds of any classification of road. However, no deviation from as-built <br />requirements of light-use roads is noticeable (Division inspections). <br />Rule 4.03.3(7) Retention <br />The application is in compliance with this rule. The Crystal River Ranch (a landowner) requested <br />retention of the conveyor comdor two-track road and the jeep road to the fan shaft by letter of <br />August 17, 1999 (PAP page 4-98d). As portions of the road to the fan shaft are located on lands <br />owned by other than the Crystal River Ranch, the Division initiated coordination with other <br />landowners. A small portion of the trail is located on land managed by the U.S. Forest Service <br />and a small portion on land managed by the Bureau of Land Management. Allowing small <br />segments of the trail to remain as is on U.S. Forest Service and Bureau of Land Management <br />lands was accomplished (telephone records of November 9, 1999). By letter of November 9, <br />1999, the North Thompson 4 Mile Mineral & Land Corporation (4 Mile) requested that the fan <br />shaft road be closed and the bridge removed. That this letter was to be interpreted as retention of <br />the road was confirmed in a personal conversation between Walker (Division) and Mr. William <br />E.L. Fates, President, 4 Mile (Division inspection report of 15 Dec 99). <br />
