This deficiency was brought <br />to the attention of the applicant by an adequacy letter of October 27, 1999. Deficiencies in the <br />Drawing were corrected in a revised drawing of 11/99, submitted under a response letter of <br />November 22, 1999. <br />Rale 2.10.3(1)(1) Roads <br />The application is in compliance with this rule. Public roads are shown as appropriate. <br />Rule 2.10.3(2) Certification <br />The application is in compliance by this rule. Both Drawings D-3-20 and D-2-5 have been <br />stamped (certified) by a registered (Colorado) engineer. <br />Rule 3 Performance Bond Requirements <br />Although the actions of this application have the potential to reduce the liability for reclamation, <br />the costs for reclamation of the roads to be permanently retained were not included in the current <br />estimates. The applicant requested no reduction in the cost estimate, and no bond release is <br />initiated by the application. <br />Rule 4.03.1(1)(f) Removal of Haul Roads <br />Rule 4.03.1(1)(f)(i) Retention <br />The application is in compliance with this rule. The retention of the haul road (from County road 108 <br />to the dump truck pad and the pad of the loadout facilities) is recognized in the PAP. The application <br />confirms this previous approval of retention as facilities in support of pastureland. Although there <br />are no performance standards for a road in support of pastureland, the haul road complies with all <br />the applicable performance standards of a haul road (certified by a registered professional engineer, <br />see Grand Mesa Coal Company letter of August 1, 1984). <br />Rule 4.03.1(1)(f)(ii) Landowner Request <br />The application is incompliance with this rule. The retention of the haul road was requested by <br />the landowners in letters of August 5, 1987 (pages 4-96a and 4-966 of the PAP) and August 14, <br />1989 (page 4-96c of the PAP), and January 19, 2000 (page 4-98e of the PAP). <br />Rule 4.03.1(7)(a) Release From Reclamation <br />By this technical revision, the Division approves retention of the haul road as suitable for the <br />
