There are no significant historic leaks or spills of toxic or hazardous pollutants at the Site. <br />43. Best Management Practices <br />The following section discusses the Best Managemerrt Practices (BMPs) at the Site. <br />4.3.1. Stormwater Diversion <br />Siormwater diversion will be one of the most effective BMPs at the Site. Stormwater diversion <br />prevents stormwater eontamination by preventing contact of Stormwater runoff with potential <br />sources of contamination. Stormwater is diverted away from all stockpiles of overburden, waste <br />rock, and ore using grading, -berms, channels, water bars, and culverts. Stotmwater is also <br />diverted from the tailings pond using ditches and berms. The tailings pond is azero-discharge <br />system. <br />4.3.2. Materials Handling And Spi11 Prevention <br />Mill processing chemicals are stored within the mill building <br />Petroleum products are stored in multiple containers on the Site. Secondary containment will be <br />provided for all petroleum containers that have a capacity of 55 gallons or more. Truck loading <br />areas are provided with secondary containment to the extent practicable. The operator shall be <br />present continuously to watch all fueling, loading, and unloading operations. Any spills shall be <br />promptly contained and cleaned up. If a spill meets the reportable quantity for petroleum <br />products (see below), the SWMP A ini¢traror shall report the sgill to the appropriate agencies. <br />If a spill .exceeds the capabilities of on-site personnel to contain and clean up, the SWMP <br />Administrator shall obtain the services of a spill response contractor. <br />If reporting is necessary, the SWMP Administrator and the Mine Manager shall be responsible <br />for external notification of the appropriate federal, state, and local. authorities. <br />Which Spills Most be Reported <br />-For petroleum products including gasoline and motor oil, Colorado regulations require <br />that any suspected or known release of a regulated substance must be reported to the State <br />Division of Oil and Public Safety (OPS) within 24 hours. The only exception to this <br />requirement is a release known to be less than 25.gallons that can be completely cleaned <br />up within 24 hours. If the owner/operator is unable to completely clean up the release <br />within 24 hours, the OPS must be notified within the 24-hour time frame. <br />2. if the petroleum release or suspected release of harmful quantity (enough to cause a sheen <br />on the water) may reach waters of the state (which include surface water, ground water <br />and dry gullies or storm sewers leading to surface water), it must also be reported <br />immediately to CDPHE (25-8-601 CRS}.
